Fibromyalgia & Chronic Widespread Pain Expert Witness
Independent, consultant-authored medico-legal reports on chronic primary pain conditions, such as chronic widespread pain (CWP) which includes fibromyalgia. Prepared to CPR Part 35 standard for claimant, defendant, and single joint expert instructions.
Fibromyalgia presents some of the hardest causation questions in personal injury litigation — a credible diagnosis does not, by itself, establish that an accident caused it. This is especially true following minor road traffic collisions and and minor work-related injuries, where temporal proximity is often the primary evidential foundation. Our faculty includes consultants in pain medicine experienced in diagnosing chronic primary pain conditions such as CWP / fibromyalgia and in the disciplined causation reasoning these cases demand.
What sets a fibromyalgia instruction apart
Fibromyalgia is not the same as CRPS or regional chronic pain
Fibromyalgia and chronic widespread pain raise diagnostic and causation issues that a generalist report can miss:
- Diagnosis rests on the ACR 2010/2016 criteria - the Widespread Pain Index and Symptom Severity Scale - not a single test or biomarker, with the Royal College of Physicians' 2022 UK clinical guideline providing the current UK-specific diagnostic framework
- No definitive biomarker, imaging finding, or histopathological test exists; diagnosis is clinical, reached through symptoms, examination, and systematic exclusion of alternative pathology
- Causation is a separate question from diagnostic validity — establishing that an accident caused, materially contributed to, or materially accelerated the condition requires more than linking symptom onset to the index event
- Assessment of the claimant's overall condition and level of disablement, including the psychosocial factors that influence presentation, treatment response, and prognosis
- Particular care where trauma is modest and pre-existing vulnerability factors are present — a common and contested scenario in minor RTC claims
A report that treats fibromyalgia causation as self-evident is a report that invites challenge. Ours don’t.
- Diagnosis against ACR criteria, exclusion of alternative pathology, and careful consideration of the UK clinical guidelines for the diagnosis of fibromyalgia syndrome published by the Royal College of Physicians
- Causation and material contribution analysis, particularly in low-speed or minor-trauma claims
- Condition and prognosis, including the interaction of pain, fatigue, and cognitive symptoms
- Functional impact and its bearing on quantum, including the significance of psychological and psychosocial factors
- Response to challenge on causation or diagnostic validity
Instruction types
Instructed across claimant, defendant, and SJE work, our fibromyalgia-experienced consultants accept instructions across:
- Personal Injury - causation analysis, especially minor RTC and low-trauma claims where causation is contested
- Clinical Negligence - diagnostic delay or mismanagement where fibromyalgia or chronic widespread pain is in issue
- Single Joint Expert instructions
- Claimant and defendant instructions, with defendant-side causation challenge where appropriate
All experts act independently and in accordance with CPR Part 35 and GMC guidance.
