Neuropathic Pain Expert Witness
Independent, consultant-authored neuropathic pain expert witness medico-legal reports, prepared to CPR Part 35 standard for claimant, defendant, and Single Joint Expert instructions.
Neuropathic pain, arising from a lesion or disease of the somatosensory nervous system, presents distinctive diagnostic and causation questions in personal injury and clinical negligence litigation, particularly where it follows trauma, surgery, or nerve injury. Our faculty includes consultants in pain medicine experienced in diagnosing neuropathic pain diagnosis, its distinction from other chronic pain presentations, and the causation reasoning these cases require.
What sets a Neuropathic Pain Expert Witness instruction apart
Neuropathic pain is not the same as CRPS or widespread chronic pain. Neuropathic pain raises diagnostic and causation issues a generalist report can miss:
- Distinguishing neuropathic pain as a symptom or clinical feature from chronic neuropathic pain as a formal ICD-11 diagnosis — a claimant may present with elements of neuropathic pain without meeting the diagnostic threshold for the condition itself
- Identification of the underlying nerve lesion or disease process — central or peripheral — rather than treating pain as a standalone symptom
- Differentiation from CRPS, which involves neuropathic features but is a distinct clinical entity with its own diagnostic criteria
- Differentiation from fibromyalgia and chronic widespread pain, which present without a demonstrable nerve lesion
- Recognition of characteristic features — burning, shooting, electric shock–type pain, allodynia, hyperalgesia — and their evidential significance
- Causation analysis where neuropathic pain follows surgery, trauma, or other index events, distinguishing new nerve injury from pre-existing or unrelated pathology
The distinction that matters in litigation isn’t whether a consultant recognises neuropathic features — most pain medicine consultants would consider themselves competent to. It’s whether the report correctly identifies where a claimant’s presentation sits: an element of neuropathic pain within a broader picture, or a diagnosis of chronic neuropathic pain in its own right, substantiated with evidence-based reasoning robust enough to withstand challenge.
- Diagnosis and identification of the underlying nerve lesion or disease process
- Causation and, where relevant, material contribution analysis
- Condition and prognosis, including treatment response and likely trajectory
- Biopsychosocial evaluation, including the psychological and psychosocial factors influencing presentation, treatment response, and prognosis
- Functional impact and its bearing on quantum, including the significance of psychological and psychosocial factors
- Response to challenge on diagnosis or alternative explanations for symptoms
